US Court Mandates Release of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was detained in immigration custody.
In her order, the judge noted that the authorities lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
